IP and Tech Transfer Issues in China: Trends & Developments

Foreign IP owners and businesses are often wary of doing business in/with China because of the risk of IP piracy and loss of technology and trade secrets. This fear has to be properly balanced against the golden opportunities that are open to all who venture into the Chinese marketplace. While the protection of IPR in China has shown modest improvements in recent years, the vast majority of companies— 98 percent—still say IPR enforcement is a major concern for them. Loke-Khoon has spent the last 25 years counseling and advising IP MNC clients how to navigate the Chinese IP system, to avoid the pitfalls of piracy. He will provide some insights into how to manage these commercial expectations and to leverage on the good, bad and ugly of the Chinese IP system.

LOKE-KHOON TAN is a partner and head of Baker & McKenzie’s Intellectual Property Practice Group in Hong Kong and China. He is a member of the IP Global Steering Committee and heads the Asia Pacific Region IP Group.
