On Tuesday the House rejected industry’s proposed floor amendment which would have provided the state with $151 Million in savings and preserved industry’s access to capital. They in-fact voted to support the existing SB199 Conference Draft which effectively kills Act 221 through the elimination of the 2:1 credit allocation policy and replaces it with a 1:1 limitation. We anticipate that the Senate will approve the bill on Thursday after which it will go to the Governor for her signature.
The ONLY RECOURSE now is to ask the Governor to VETO the bill. We expect that she will quickly sign the bill into law so your IMMEDIATE action is required. Let the Governor know how angry you are with this bill by telling her how it specifically impacts you or your company. Tell her that it undermines the innovation economy, kills jobs, kills companies and kills Hawaii’s future.
Soon we will provide you with a detailed description of how events have unfolded. For now, however, TAKE ACTION.

I strongly encourage those who support Act 221 to write a personalized email and follow up with a phone call. After writing about our specific situation I received three responses from legislators and a call from the Governor's office inquiring about the details. They seem to be listening.

I've been told by several local politicians that form letters get very little consideration.

Superb Internet chose to make the move to Hawaii partially because of some of the Act 221 benefits. As most business growth does, we've brought jobs and helped stimulate the local economy. In this economic downturn and with Hawaii's primary industry, tourism, being so negatively affected it only seems obvious to invest in other budding industries such as hi-tech.

Here's what I sent, feel free to plagiarize...

Dear Governor Lingle,

I am the recipient of your September 2008 Innovation Award, for which I am grateful. Nonetheless, I am asking you to veto SB 199 should it arrive at your desk as currently written. I am aware that you are not a fan of Act 221, the High Tech Tax Credits. SB 199 effectively guts these credits.

While the credits may not be the most effective way to invest in the high technology business community, they are pretty much the only vehicle in place today. Eviscerating 221 without a serious replacement (such as increased funding for the UW Engineering Department) is short-sighted. It is hard enough to raise money in Hawaii; with an emasculated Act 221 it will be nearly impossible. Even now I am looking at options that will require me to relocate my company to the mainland.

If you hope to get Hawaii off the tourism rollercoaster, please re-consider your position.
