Reading the testimony for HB2288, there were basically two letters in support (Honolulu Police, and one private citizen)  and dozens in opposition.  

The hotel/tourist folks dont seem to have caught on to this yet.  It could be very bad for them both in financial burden and as a turn-off for potential visitors.

Hawaii HB2288 may have gone down in flames (ok Deferred, but its basically dead), but there is an almost identical bill in the senate SB2530. Call or email your senator now ... http://www.capitol.hawaii.gov/measure_indiv.aspx?billtype=SB&billnumber=2530  

Here is the basic text I sent to Senator English (upcountry maui)

The basic text says would require all "Internet Service Providers" (a company that provides access to the internet)  to record user information and internet history for at least 2 years.

1) this is a poorly written law that fails to account for the technology it seeks to regulate. The data requested would be of little use in any criminal investigation.
2) seeking to retain this data is a severe invasion of privacy, potentially unconstitutional
3) it puts an extreme financial and technical burden on the service providers, which would include not just large telecoms (Verizon, Hawaiian Tel) but small coffee shops, hotels and just about any company that uses the internet. (note: the bill does not say provides to public, but just 'provides access to internet'.  That could be construed as providing access to employees.)
4) improper security of the retained data is almost guaranteed. Depending on what is actually saved by the ISP, the data could be a tempting target for criminal elements.
5) there are no provisions for circumstances under which it should be turned over to ?? (unstated - law enforcement? political parties? citizens?)
5) This wil make a wonderful new slogan for tourism "What Happens in Hawaii stays on our poorly secured servers for at least two years".

My rep., Gil Riviere, emailed me last night and said the bill didn't pass out of committee, so it's most likely dead for this year.

I would be my dream come true for the tech community to band together, find a candidate that will run against each legislator who put their name on this bill, and beat them in the next election. If we could flex our political muscles like that, we would never see destructive bills cross us ever again.

The financial burden will be devastating to not just internet companies, but any ISP --- which includes HOTELS and COFFEE SHOPS.   And can you imagine the publicity effect this will have on Tourism?  "Come to Hawaii - We will remember EVERY web site and email you sent for 2 years."

Very Bad Bill in Hawaii ...

Rep John MIzuno of Oahu is lead sponsor of a new bill that requiring the creation of virtual dossiers on state residents. The measure, H.B. 2288, says "Internet destination history information" and "subscriber's information" such as name and address must be saved for two years.  H.B. 2288, which was introduced Friday, says the dossiers must include a list of Internet Protocol addresses and domain names visited. 

We need to stop this thing ASAP.

And then get rid of anyone who sponsored or supports it.

After a brief presentation of the Hawaii Broadband Initiative, there will be an opportunity for the audience to provide their input.

  

Yuka brings over 10 years of executive management and startup experience in the Internet industry, as a co-founder of LavaNet, an award-winning local ISP.  She leverages to navigate within the government and to bridge the gap between the public sector and the community. HTDC's projects include the management of the Manoa Innovation Center and the Maui Technology and Research Center. She serves as an adviser to many organizations including Pacific Center for Advanced Technology Training and the Small Business Development Center of Hawaii.

HSTC is changing its position on HB2867 HD1. We will be neutral and submitting comments only. This bill is similar to HB2984 HD2 in that our membership is split.
