No Dan has it right.  I was wondering whether Pine should could sued for libel, although perhaps the allegations were true.  Perhaps she did not have evidence that of who created the website?  

I also wonder what are the laws if any about using someone's name without their permission and to discredit them or make them look bad, or just piss them off.  For example, say someone created a MyKarenChun.com blog that celebrated right wing causes. Karen should have some redress, no?   Would this be in the publicity rights part of copyright law?  Identity theft?  If we can answer this for the legislators we might avoid obnoxious measures like HB2288

I think David Fisher was talking about Rep Pine introducing this draconian bill to get her web designer - not the site where her disgruntled web guy sets out the case against her.

Are you referring to Eric Ryan's site about Rep. Pine? The legal test for libel requires that the statement be malicious and factually inaccurate. Of course, making statements like "the extremely corrupt Kimberly Pine" without proof is a bad idea both legally and in the interest of civil debate. The best outcome would be for these legislators to realize why their bill, which I'm sure was well intentioned, is a bad idea. Name calling normally doesn't produce this sort of result.

Just got off the phone with Rep Angus McKelvey (West Maui) chair of the committee that killed HB2288 (track your internet pages) He gave me permission to tell the inside story on this:

Rep. Kymberly Pine (R) was all hot for this bill. McKelvey, because he is a technical guy, immediately saw all the problems with the bill. But, he told me,

"You can't kill a bill and make sure it stays dead unl...ess you HEAR the bill".

He also wanted to get all the tech guys to come, testify and get all the problems with the bill on the record.

So he got the testimony against the bill on the record, exposed Rep Pine for creating it and then killed it dead, dead, dead.

So no need for my panicked call to his office...he was 3 steps ahead of me in the chess game and had already checkmated the bill's proponents.See More


My thoughts: Now we are just left with the question, why would a DEMOCRAT (John Mizuno) go along with this?

            Perhaps the fact that John Mizuno sponsored a bill demanding that all people living in govt subsidized housing be drug testing may give us a clue.

            I'm not feeling sorry for the blizzard that is descending on Mizuno any more.

bit by bit 'our' 'representatives' - both words used advisedly and with a certain amount of tongue in cheek - will begin to understand that they need to understand stuff before they start to suggest legislation to improve their subjects lives.

LOL!!  Kudos to whoever created JohnMizuno.com!!! - sounds like something I'd do but I didn't do it ..hand to heart.  But I am a huge fan of whoever did create it!

LOL! This is good. Pat suggested we introduce an opposing bill called the "Protect Children from Hawaiian Bears Act". That sounds even scarier than pornography.

CNET reporter Declan McCullagh presented a theory in his article: "Pine, who did not immediately respond to queries, has been targeted by a disgruntled Web designer, Eric Ryan, who launched KymPineIsACrook.com and claims she owes him money, according to an article last summer in the Hawaii Reporter. Her e-mail account was also reportedly hacked around the same time. The article said Pine would advocate for "tougher cyber laws at the Hawaii State Capitol" as a result. "
